CRL.M.C.3762/2016 This is a petition under Section 482 Cr.P.C. filed on behalf of the petitioner seeking quashing of FIR No.337/2013, under Sections 498-A IPC, registered at P.S. K.N.Katju Marg, Delhi.
Counsel for the petitioner submits that the matter has been amicably settled between the petitioner and the respondent No.2/complainant before the Delhi High Court Mediation and Conciliation Centre vide Settlement
Agreement dated 30th May, 2015 annexed as Annexure P-2 at page 48 of the paper book. He further submits that in terms of the said settlement, the petitioner and the respondent No.2/complainant are now living together as husband and wife. He, accordingly prays that the FIR No.337/2013 and all subsequent proceedings may be quashed against the petitioner. The respondent No.2/complainant is present in Court and is identified by the Investigating Officer, SI Satender Kumar. She also confirms the fact of amicable settlement with the petitioner and submits that she is now happily and peacefully residing with the petitioner and she has no claim or grievance left against the petitioner. She accordingly prays that the FIR No.337/2013 may be quashed against the petitioner.
In view of the fact that the matter has been amicably settled between the parties and the petitioner and respondent No.2 are now living together as husband and wife, in the interest of justice, no fruitful purpose would be served by continuing with the criminal proceedings against the petitioner. hence the FIR No.337/2013, under Sections 498-A IPC, registered at P.S. K.N.Katju Marg, Delhi and all subsequent proceedings against the petitioner are hereby quashed to meet the ends of justice. The petition is disposed of accordingly.
