O R D E R

% 04.10.2018 Learned counsel for petitioner submits that petitioner came in contact with the prosecutrix through facebook. Petitioner and prosecutrix became friends.

Prosecutrix had accompanied the petitioner to Ambience Hotel of her own.

Petitioner checked the mobile phone of prosecutrix in the hotel room and found that complaint of rape against him was forwarded by the prosecutrix to lawyer through whatsapp on 16th July, 2018. Prosecutrix has lodged the present FIR on 24th July, 2018 alleging therein petitioner had raped her on 23rd July, 2018 only in order to blackmail the petitioner. Petitioner himself went to police station and joined the investigation. He was arrested. Petitioner is in custody for the last 2 months. As per MLC no fresh injuries were noticed.

Keeping in mind the totality of the facts and circumstances of this case, petitioner is admitted to bail, subject to his furnishing a personal bond in the sum of `25,000/- (Rupees Twenty Five Thousand Only) with one surety in the like amount to the satisfaction of the trial court.

Bail application is disposed of in the above terms.
