% 13.11.2018 CM APPL.46920/2018 in MAC.APP. 437/2015 This is an application under Section 151 of CPC filed by respondent No.1/ claimant/applicant for the release of the FDR. Learned counsel for the applicant/respondent No.1 has submitted that the main appeal has already been disposed of in terms of the settlement. The amount so settled between the parties was kept in the form of FDR and the claimant at the relevant point of time was minor but now she had attained the age of majority and since she had already attained majority, the FDR so made be released in favour of the respondent No.1/ claimant/applicant. Mr. Pankaj Gupta, Counsel for appellant-insurance company submits that he has no objection, if the said FDR be released in favour of claimant.

In view of the submissions made by learned counsel for the respondent No.1-claimant/applicant and for the reasons mentioned in the application, the application is allowed with directions to the Manager, UCO Bank, Delhi High Court Branch, New Delhi to release the amount of the said FDR i.e. FDR No.153748 of Rs.4,00,000/- into the account of respondent No.1-claimant/applicant being No.15530110112434 along with the interest accrued thereon, if any, forthwith, as per rules. The Manager, UCO Bank, Delhi High Court Branch, New Delhi, be apprised of this order forthwith, to ensure its compliance. With aforesaid directions, the application is disposed of. Copy of this order be given dasti under signatures of the Court Master.
