North Delhi Municipal Corporation v. Dr. Soobrata Roy
$~82 *
IN THE HIGH COURT OF DELHI AT NEW DELHI
+ W.P.(C) 32/2015 and CM No. 58/2015 NORTH DELHI MUNICIPAL CORPORATION ..... Petitioner Through:
Mr R.V. Sinha and Mr A.S. Singh, Advocates.
Versus
DR. SOOBRATA ROY ..... Respondent Through:
Respondent in person.
CORAM:
HON'BLE MR. JUSTICE VIBHU BAKHRU
O R D E R
% 18.09.2017 1.
On 28.08.2017, this Court had taken note of the clarification that the respondent was not seeking any information pertaining to any third party or any departmental enquiry instituted against any third person; he had merely desired to examine the file relating to his request under the Right to Information Act, 2005 and to confirm the manner in which his request was dealt with.
2.
The learned counsel for the petitioner had sought time to take instructions, whether the respondent would be provided inspection of the relevant files. This Court had further directed that in the event the petitioner was of the view that such inspection ought to be denied to the respondent, the petitioner would file an affidavit indicating the reasons thereof. 3.
The learned counsel appearing for the petitioner fairly submitted today that there was a misunderstanding as to the information sought by the respondent and it appeared that the respondent was seeking information
relating to a third party.
4.
In view of the clarification provided by the respondent, clearly the reasons why information sought by the respondent was denied to him - that is, that the information related to the third parties - no longer hold good. 5.
Accordingly, the present petition is disposed of by directing the petitioner to provide the information as specifically clarified by the respondent and as noted in the order dated 28.08.2017. The pending application is also disposed of.
6.
Order dasti.
