O R D E R

% 08.10.2015 It has been submitted on behalf of the petitioner that with the efforts of the mediator, the dispute between the husband and the wife has been settled.

It has been agreed upon by the parties to the case that the petition under Section 125 of the Code of Criminal Procedure would be withdrawn and the parties would also withdraw respective claims against each other. As part of agreement, it has further been decided by the petitioner and his wife that they would go for a divorce with mutual consent and on the first motion for divorce, the petitioner shall pay a sum of Rs.2 lakhs to his wife. Rs.1.5 lakhs is required to be paid by the petitioner at the time of recording of the statement in the second motion. Another instalment of money has been promised to be paid to the wife

on quashing of the FIR No.888/2014 in which the petitioner seeks bail. Considering that the dispute (matrimonial) has been settled and the complainant/informant has consented to facilitate the quashing of the first information report lodged by her, this Court is inclined to confirm the provisional anticipatory bail granted to the petitioner. The petitioner shall be released in the event of his arrest on bail on his furnishing bond in the sum of Rs.5000/- with one surety of the like amount to the satisfaction of the arresting officer/SHO of the concerned police station.

The application is allowed and disposed of accordingly. Dasti.
