O R D E R

% 15.09.2017 This is an application under Section 438 Cr.P.C filed on behalf of the petitioner for grant of anticipatory bail in case FIR No.842/2016, under Sections 376/354(D) IPC, registered at Police Station K.N.Katju Marg, Delhi.

Learned counsel for the petitioner has submitted that the petitioner is anticipating arrest in the above case from the police officials of Police Station of K.N.Katju Marg, Delhi. Counsel for the petitioner has further submitted that the victim is major and the allegations as alleged in the FIR are false and baseless. Counsel further submits that there is a delay of 24 years in lodging the present FIR and further submits that the petitioner has already joined the investigation and is ready to join further investigation as and when required and prays that the petitioner may be released on

anticipatory bail.

Learned APP for the State has vehemently opposed the bail application and has submitted that the petitioner has ruined the life of the complainant/victim and submits that the bail application may be dismissed. It is apparent on the record that the victim is major and there is a delay of 24 years in lodging the present FIR and the allegations in the FIR are not specific in nature, in these circumstances, the petitioner is directed to join further investigation and in the event of his arrest, the petitioner be released on anticipatory bail, on his furnishing bail bond in the sum of Rs.

20,000/- with one surety of the like amount to the satisfaction of the IO/SHO concerned, with the condition that he shall not visit the house of the victim and shall not make any contact either telephonically or through social media and he shall not make any inducement or threat to the victim and he shall not leave the country without prior permission of the concerned Court below and he shall not tamper with the prosecution evidence. The present bail application is allowed and stands disposed of accordingly.
