Learned counsel for the petitioner has tendered in court the result on the opening of the sealed cover. On opening the sealed cover, it is found that the respondent has been assessed fit in all the vacancy years and on the basis of the assessment, the Committee of the three officers of the petitioner has recommended that his name may be included in panel at Serial no.2-B, below Shri R.P. Garg (Sl. No.2) and above Shri D.K. Jolly (S.No.3) for the vacancy year 1997-98, subject to securing a clearance of vigilance case pending against him and the competent authority furnishing the requisite integrity certificate in his favour.

He has been recommended in an unreserved vacancy.

There is no dispute that at the relevant point of time i.e. vacancy year 1997-98, there was no vigilance case pending against the respondent.

The petitioner is directed to proceed to pass appropriate orders in the light of the aforesaid development. This writ petition is disposed of accordingly.
