% 16.10.2018 IA 14413/2018(u/O.XXIII Rule 3 & 3A CPC) This is a joint application filed by parties under Order XXIII Rule 3 of the Code of Civil Procedure (CPC) for passing of decree as per the terms contained in para 4 of the joint application. The application is signed by the plaintiff and all the defendants as also by the learned counsel appearing for the parties. The terms and conditions of the Settlement are spelt out in para 4 of the application.
The parties have amicably settled their dispute regarding the estate of late Shri Gurbachan Singh Sachdeva. The terms and
conditions of the Settlement are legal and valid. The application is allowed.
CS(OS) 226/2017 & IA 12874/2017, 1274/2018 Learned counsel for the plaintiff also submits that CS No.645/2017, is also pending in the Court of Shri Sunil Kumar, Civil Judge, Rohini Court.
Learned counsel for defendant No.1 submits that the suit shall be withdrawn within two weeks from today. decree is passed in terms of para of IA 14413/2018(u/O.XXIII Rule 3 CPC) with Annexures. The parties shall remain bound by the terms and conditions of the Settlement Agreement.
The suit stands disposed of.
Keeping in view the settlement at an early stage, the plaintiff shall be entitled to refund of 50% under Section 16-A of the Court Fee Act, 1870.
