O R D E R

% 01.02.2016 Learned counsel for the parties submit that the arbitration proceedings in the above said matter have already been commenced, thus, the present petition be treated as an application under Section 17 of the Arbitration and Conciliation Act, 1996. With the consent of both the parties, this petition is treated as an application under Section 17 of the Arbitration and Conciliation Act, 1996, to be heard and decided by the Arbitrator. The petitioner shall file copy of this petition before the Arbitrator within two weeks from today.

Reply and rejoinder to this petition be filed by the parties directly before the Arbitrator.

Learned counsel for the respondent has no objection if the interim order dated 29th May, 2015 shall continue till the decision of the application under Section 17 of the Act by the Arbitrator, subject to the condition that the petitioner will keep the Bank Guarantee in

question alive. Ordered accordingly.

The petition is accordingly disposed of.
