O R D E R

% 02.11.2016 Mr. Akhtar has tendered in Court a status report as well as copy of nominal roll, which are taken on record.

The petitioner has preferred the present petition to seek a direction that he be released on parole on the ground that his father has passed away and he is required to perform rituals and also make arrangements for needs of the family.

The nominal roll shows that petitioner stands convicted in case FIR No.45/2009 under Section 304(1) IPC registered at PS - Anand Parbat. He has been sentenced to 10 years Rigorous Imprisonment with fine. His

appeal has been dismissed by this Court on 29.09.2014. As on 27.10.2016, he has undergone 7 years and 7 months of incarceration and earned remission of 11 months and 18 days. He was lastly released on parole for a period of 3 weeks between 12.02.2016 to 04.03.2016. It is not reported that during this period he has misused the liberty. His jail conduct is satisfactory. The address of the petitioner as well as the factum of demise of his father have been got verified.

In these circumstances, the petition is allowed. The petitioner is directed to be released on parole for a period of four weeks upon furnishing personal bond with one surety in the sum of Rs.10,000/- to the satisfaction of the Jail Superintendent. At the time of his release, he shall provide his mobile phone number, which shall be kept in working condition at all times and shall not be changed without prior intimation to the Court. He shall mark his attendance on every Monday at 11:00 a.m. at the local police station during the period of his parole. He shall duly surrender at the end of the parole period.
