O R D E R

% 21.11.2017 IA No. 13414/2017 This is a joint application filed by the parties stating that the suit was transferred to the lower court for adjudication. However, prior to the transfer, this court while granting ad interim relief directed to the plaintiff to deposit a sum of Rs.19,11,000/- with the Registrar General of this court which was to be kept in a fixed deposit.

During the pendency of the suit, it is said to have been compromised under Order 23 Rule 3 CPC. The court on 15.09.2016 recorded the settlement of the parties and the suit was decreed in terms of the settlement dated 04.08.2016. As per the memorandum of settlement, it has been agreed that the sum of Rs.19,11,000/- lying deposited with the Registrar General of this court be released in favour of the defendant to which the plaintiff has no objection.

Mr. Anil Bedi, the defendant, who is present in person states that he

has no objection to the application.

Accordingly, the application is allowed.

The Registrar General may encash the FD and give the sum of Rs.19,11,000/- along with accumulated interest to the defendant. The parties will thereafter take steps as per the decree/settlement. The payment to the defendant shall be released in the presence of the learned counsel for the plaintiff. Concurrent with the release of the amount in favour of the defendant, the defendant shall hand over original title papers of Flat No. ED-53A, Pitam Pura, Delhi to the plaintiff. The application stands disposed of.
