O R D E R

% 26.09.2017 The petitioner seeks bail in anticipation of his arrest in connection with FIR No.146/2017 dated 22.04.2017 (P.S.Alipur) instituted for the offences under Sections 33/58(D) of the Delhi Excise Act, 2009. Pursuant to the order dated 22.05.2017, the petitioner has joined investigation.

Mr.Arun Kr.Sharma, APP, however, submits that the petitioner has not yet given any proof of the fact that he had given the vehicle in question to somebody else for repairs and the vehicle was unauthorisedly used during that period.

The petitioner undertakes to provide all information to the investigating agency which he is in know of.

Taking into account the nature of accusation and the fact that the petitioner has been participating in the investigation, this Court is inclined to

confirm the interim protection given to him by order dated 22.05.2017. The petitioner, in the event of arrest or surrender, shall be released on bail on furnishing bond in the sum of Rs.10,000/- with one surety of the like amount to the satisfaction of the Arresting Officer/Court. Needless to state that the petitioner shall continue to participate in the investigation and his avoiding the same would entitle the police to take steps for cancellation of the anticipatory bail granted to him. The application is disposed of.
