The petitioner seeks regular bail under Section 439 Cr.P.C. in case FIR No.62/2016 registered under Sections 376D/313/354/354A IPC and Section 12 POCSO Act at PS Ambedkar Nagar. Status report is on record.

I have heard the learned counsel for the parties and have examined the file.
The petitioner is in custody since 30.01.2016. Status report reveals that the petitioner and the prosecutrix were acquainted with each other since 2011.
The petitioner allegedly promised to accept her as his wife and also to take care of her daughter.
Status report further reveals that after solemnization of marriage both of them started living together as husband and wife. The prosecutrix alleged that she became pregnant thrice. Her pregnancy was aborted at the instance of the petitioner. She levelled BAIL APPLN. 2030/2016
allegations against the petitioner for making obscene gestures towards her daughter on 13.09.2015. However, no police report was lodged. Allegedly on 17.09.2015, the victim was called at Pragati Maidan where the petitioner promised to live with her. It is alleged that thereafter she was taken Pushpa Bhawan where the petitioner and his friends sexually assaulted her.
The act was repeated with her approximately for ten days.

Considering the facts and circumstances of the case, the petitioner is admitted to bail on furnishing personal bond in the sum of ` 50,000/- with one surety in the like amount to the satisfaction of the Trial Court.

The bail application stands disposed of.
