O R D E R

% 16.08.2017 Matter taken up today as 14.8.2017 was declared a holiday on account of Janamashtami.

Petitioner is a minority educational institute covered under Article 30(1) of the Constitution of India. Petitioner has applied to the National Council of Teacher Education (NCTE)/respondent no.1 for grant of recognition for its D.El.Ed. Course with an application for the Session 2016-17. Petitioner had also deposited a sum of Rs.1,50,000/-. Petitioner was informed that the hard copy of the online application has not been submitted which the petitioner submitted explaining the delay for the reason because of the pendency of the application for an NOC with SCERT. The application of the petitioner was rejected on 17.6.2016 for non-submission of the NOC. Petitioner was aggrieved. Contention of the petitioner is that a similar issue has been decided by the judgment delivered on 23.02.2017 by

this Court in WP(C) 3231/2016 Rambha College of Education Vs. National Council of Teacher Education and Anothers. Submission is that the case of the petitioner is required to be considered afresh in the light of the aforenoted judgment.

On advance notice, learned counsel for respondent has instructions from the Department. He submits that the appeal has been filed against the aforenoted judgment Rambha College (supra) which has since been dismissed on 09.8.2017. Her instructions are that the case of the petitioner shall be re-examined in accordance with law within an outer limit of four weeks and the same shall be conveyed to him. This would be for the next academic session 2018-19. This satisfies the prayer of the petitioner in the present petition.

Petition disposed of in the above terms.
