% 18.01.2018 CM APPL. 46441/2017(withdrawal of appeal) This application seeks withdrawal of the appeal with the direction to the Trial Court to hand over a demand draft of Rs. 3,20,000/- to the appellant as well as waive the costs of Rs. 10,000/- imposed by this Court on 16.11.2017.

The application has been signed by the appellant and it is supported by his affidavit.

The Court is inclined to allow withdrawal of the appeal. It is so ordered. However, the relief regarding handing over of a demand draft of Rs. 3,20,000/- is declined, so is the relief for waiving of the cost. The cost of Rs. 10,000/- shall be paid to the respondent before the learned Trial Court.

The application is disposed off in the above terms. The Trial Court Record be returned.

The appeal and other pending applications are dismissed as withdrawn in the above terms.
