This petition under Section 11 of the Arbitration and Conciliation Act, 1996 has been filed by the petitioner seeking appointment of a arbitrator for adjudication of the disputes that have arisen between the parties under the Agreement dated 1st June, 2014. 2.
The counsel for the respondent submits that a reply to the petition has been filed yesterday. However, the same is not on record. The counsel has handed over a copy of the same. 3.
The counsel for the respondent submits that, without prejudice to the rights and contentions of the respondent to raise all pleas before the arbitrator to be appointed by this Court, the respondent has no objection if the parties are referred to the Delhi International Arbitration Centre (DAC) for appointment of a sole arbitrator for
adjudication of the disputes that have arisen between the parties. 4.
In view of the above and with the consent of the parties, I refer the parties to the DAC, who shall appoint a sole arbitrator for adjudication of the disputes that have arisen between the parties under the Agreement dated 1st June, 2014. The arbitration and the fee shall be governed by the rules of the DAC. All contentions of either parties would remain open before the Arbitral Tribunal so constituted. The parties shall appear before the DAC on 18th December, 2017 at 2 PM.
