Counsel appears for the caveators. Caveat accordingly stands discharged.

+RFA No.561/2017 and C.M. Nos.21051/2017 (for condonation of delay), 21052/2017 (stay) & 21053/2017 (exemption) 2.

During the course of arguments, counsel for the parties as instructed by the parties agree that the appeal be disposed of by the consent order that the appellant will get time upto 30.6.2020 to vacate the suit premises and the appeal accordingly on merits would be disposed of as not pressed.

Accordingly, let the appellant file an affidavit of undertaking in

this Court to vacate the suit premises on or before 30.6.2020 within a period of two weeks from today and in which affidavit appellant must also undertake to clear all dues towards electricity, water etc etc as payable to the local authorities till the time the appellant stays in the suit premises. Upon the appellant filing the undertaking and complying with the terms of the same, while the appeal will be disposed of as not pressed but appellant is granted time to vacate the suit premises on or before 30.6.2020. 4.

Appeal is accordingly disposed of in terms of aforesaid observations.
