O R D E R
% 18.10.2016 On the complaint of respondent no.2 (wife), the present FIR No.872/2015 was registered against petitioner (husband) under Sections 354/354B/323 IPC at police station R. K. Puram. Petitioner and respondent no.2 have settled their disputes vide memorandum of understanding dated 15th December, 2015. FIR No.944/2015 under Sections 406/498A/377/34 IPC registered at police station Safdarjung Enclave has already been quashed by the learned Single Judge of this Court vide order dated 4th August, 2016 passed in W.P.(Crl.) No.380/2016. A sum of `4,50,000/- has already been paid by petitioner to respondent no.2, in terms of settlement.
Out of remaining amount, a sum of `2,50,000/- has been paid by petitioner to respondent no.2 today vide a demand draft, photocopy whereof has been placed on record. Balance settled amount of `2,00,000/- is to be paid at the time of second motion.
Parties shall abide by the terms of settlement. Respondent no.2 has no objection, in case the present FIR is quashed. Keeping in mind the fact that parties have settled their disputes before the mediation centre and the FIR No.944/2015 under Sections 406/498A/377/34 IPC has already been quashed by the learned Single Judge of this Court, in the interest of justice, the present FIR No.872/2015 under Sections 354/354B/323 IPC registered at police station R. K. Puram is quashed.
Petition is disposed of in the above terms.
