% 23.05.2017 During the incident which was reported by the second respondent herein it having become the subject matter of investigation of FIR No.118/2015 of Police Station Jafarpur Kalan besides causing hurt to the said first informant, the unlawful assembly of which the petitioners are alleged to be the members had not only illegally trespassed into the premises, wrongfully confining the person present there but also causing mischief by damaging the property of the company which was running the toll booth, also committing offence of theft in the process. The present petition based on memorandum of understanding and settlement deed entered into on 27.01.2017 by the petitioner with the second respondent vaguely states that the entire settlement amount to the complainant company has already been paid.

W.P.(CRL) 1565/2017

The company whose property was damaged is not a party to the settlement or to these proceedings. In these circumstances, it is not a fit case for quashing.

Dismissed.
