CORAM:
HON'BLE MR. JUSTICE A.K. PATHAK
O R D E R
% 26.05.2017 Petitioners have prayed that counting of the votes as well as results declared on 15th May, 2017 of the elections/polling of the Shahdara Bar Association held on 12th May, 2017 may be declared as null and void and illegal and re-elections be ordered.
Petitioners contested the elections for the posts of President, VicePresident, Secretary and Lady Executive Member respectively and have lost the elections.
They have challenged the result of elections alleging irregularities in the polling, counting and declaration of results, inter alia, on the grounds that polling started late and was closed one hour prior to the
closing time, date of counting was advanced without informing the petitioners and results were declared the next day. I am not inclined to entertain this writ petition since alternative remedy of filing a suit for declaration and injunction is available to the petitioners for getting the elections declared null and void and for holding of fresh elections, wherein facts can be more aptly verified. Writ petition is not entertained and dismissed. Miscellaneous application is disposed of as infructuous.
