% 29.08.2017 Learned counsel for the petitioner submits that it appears that presently there is no auction as has been averred in the petition. She seeks to withdraw the petition with liberty to take steps as per law in the eventuality of any steps being taken.

Learned counsel for the respondent submits that this court would have no jurisdiction to try the matter. He, however, without prejudice to the said contention does not object to the withdrawal of the petition. Petition is dismissed as withdrawn with liberty granted as prayed for by the petitioner.
