The counsel for both the plaintiffs namely Ms. Chhaya Devi and Prabhat Zarda Factory (India) Pvt. Ltd.; counsel for defendants No.1 to 8 namely Sh. Jyoti Kumar Arya, Jyoti Kumar Arya HUF, Shri Purshottam Kumar Arya, Smt. Malti Devi, Shri Jai Kumar Arya, Sh. Ujjwal Arya, Sh. Gaurav Kumar Arya and Smt. Manju Devi and the counsel for the defendants No. 9 to 11 namely Smt. Girija Devi, Sh. Shankar Prasad and Smt. Ratna Devi have mentioned the matter. They state that this suit stands withdrawn in terms of order dated 4th December, 2017 of the Supreme Court in SLP (C) 31747/2017.

The suit is dismissed as withdrawn.

In terms of the aforesaid, Crl.M.A.14859/2017 filed by defendant No.1 is also dismissed as withdrawn.

On request of the counsel for the plaintiffs, a certificate entitling the plaintiffs to refund of court fees paid on the plaint less Rs.50,000/- be issued and handed over to the counsel for the plaintiffs. RAJIV SAHAI ENDLAW, J.
