% 26.09.2016 C.M.No.35585-86/2016 (exemption) Exemption is allowed subject to just exceptions. Applications disposed of.
W.P.(C) 8639/2016 & C.M. No.35587/2016 Petitioner is stated to be vending in front of shop No.31, Babu Market, Sarojini Nagar Market, New Delhi. In support of his stand the petitioner has placed on record a challan of the year 2000 as also certain other challans. Submission of the petitioner is that she is adequately protected under Section 3(3) of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014.
Per contra, learned counsel for the respondent submits that the
challans filed by the petitioner on record do not create any vested right in favour of the petitioner.
Be that as it may, noting the above factual position. This Court is of the view that this petition can be dispose of with liberty granted to the petitioner to approach the Town Vending Committee (TVC) of the New Delhi Municipal Council which has already been constituted. Accordingly, Petitioner is granted liberty to approach the concerned TVC to get addressed his grievance.
No further orders are called for in this petition. Petition disposed of.
Order dasti.
