% 31.05.2017 The petitioner, who is an accused in FIR No.111/2016 dated 06.07.2016 (PS Crime Branch) instituted for the offences under sections 20/25/29 of the NDPS Act, 1985, has sought interim bail for a period of two months for the purposes of operation of his wife for Appendix. The petitioner was granted interim bail for four weeks by the Trial Court but the interim bail could not be made use of by the petitioner because his wife could not be operated upon because of her ill health. The operation was thereafter, as stated, scheduled on 28.05.2017; on which date also, the operation could not be performed.
The petitioner, it has been submitted, promptly surrendered before the jail authorities on the end of the period of four weeks of interim bail. The status report reveals that the date of operation, now, has not been fixed by the Doctor and it would depend upon the condition of health of the
wife of the petitioner.
In that event, the prayer of interim bail is rejected. However, the petitioner is at liberty to approach the court below again when the date of operation is fixed and the wife of the petitioner is in fit health condition to undergo the rigours of the operation.
