CORAM:
HON'BLE MR. JUSTICE SIDDHARTH MRIDUL
O R D E R
% 20.09.2018 Learned counsel appearing on behalf of the petitioners limits the relief in the present proceedings to a declaration that, the degrees of Bachelor of Veterinary Science and Animal Husbandry (B.V.Sc. & A.H.), awarded to them, by Shri Ganganagar Veterinary College/respondent No. 4, be treated as valid for all purposes.
Learned counsel appearing on behalf of the parties state that, the declaration sought on behalf of the petitioners, is now covered on all fours, by the directions issued by the Hon'ble Supreme Court of India, vide order dated 12th August, 2016, in SLP Nos. 13465-13466/2016, titled as "Rahul Choudhary Etc. vs. ICAR & Ors.", whereby, it was directed that, the degrees obtained by the petitioners in those proceedings, which is pari materia with W.P.(C) 4786/2017
the declaration sought for in the proceedings at hand, be treated as valid for all purposes.
In this behalf, it is further observed that, in the counter affidavit filed on behalf of the Veterinary Council of India/respondent No. 2 herein, it is conceded by them that, the relief now prayed for, on behalf of the petitioners, is covered by the decision of the Hon'ble Supreme Court of India in Rahul Choudhary Etc. (supra).
In this view of the matter, the present petition is partly allowed. It is declared that, the degrees of Bachelor of Veterinary Science and Animal Husbandry (B.V.Sc. & A.H.), obtained by the petitioners, shall be treated as valid for all purposes.
Needless to state that, the direction to treat the degrees obtained by the petitioners as valid for all purposes, would not extend or create any equities in favour of the respondent No. 4 College. No further directions are called for in the present petition. With the above directions, the petition is disposed of. Pending application also stand disposed of.
Copy of the order be given dasti to learned counsel for the parties under signature of the Court Master.
