O R D E R

% 08.03.2025 Appellant insurance company has filed an appeal for reduction of the award dated 06.04.2017 passed by the Learned MACT, awarding a compensation of Rs. 10,70,000/- along with interest @ 9% p.a. from the date of DAR. On appeal, the insurance company deposited entire awarded amount with up to date interest in terms of the order dated 25.05.2017 passed by this Hon'ble Court to be deposited before the tribunal and 50% of the awarded amount was directed to be released.

We have interacted with the learned Counsel/parties concerned. Apropos such interaction and due deliberation, it is agreed by the parties that in view of the settlement arrived in MAC APP 274/2018, learned counsel for insurance company has instructions not to press the appeal.

In view of the above settlement, it is directed that balance awarded amount lying deposited before the Tribunal with interest, if any, be released to the respondent(s)/claimant(s) in terms of the award of the Tribunal.

The statutory amount deposited as a pre-condition for filing appeal with interest, if any, be refunded to the Insurance Company. The present appeal alongwith the pending application(s), if any, is disposed of with directions in terms of the foregoing settlement. A copy of this order be sent to concerned Ld. Tribunal with LCR, if requisitioned and received.
