% 13.05.2020 This matter is being heard through video-conferencing. CM. No. 10850/2020 Exemption allowed subject to all just exceptions. Application stands disposed of.

CM. No. 10849/2020 This is an application filed by the applicant / appellant no.2 with the following prayers:

"It is, therefore, most respectfully prayed that this Hon'ble Court may be pleased to:- a) extend the time for vacating the suit premises i.e. property bearing no. 2682, Main Bazar Shadipur out of Khasra no. 424, Village Khampur Raya, Delhi till 31.12.2020 in the facts and circumstances stated in the application above;

b) Pass any other order as this Hon'ble Court deem fit and proper in the facts and circumstances of the case" Mr. Rajan Chaudhary, learned counsel appearing for the respondents

states that reasonable time be granted to the appellant no.2 for vacating the premises, on payment of reasonable charges for use and occupation. Having heard the learned counsel for the parties for some time, this court is of the view that, in view of the prevailing situation arisen because of COVID-19 reasonable time be granted to the appellant no.2, who is said to be in occupation of the premises, for vacating the same. Accordingly, the appellant no.2 is granted time till September 30, 2020. This time period is also accepted by Mr. Chaudhary. It is also clarified that no charges shall be paid by the applicant / appellant no.2 for use and occupation of the premises till September 30, 2020.

Application stands disposed of.
