% 24.05.2017 CM 19984/2017 (Exemption) 1.

Exemption allowed, subject to all just exceptions. 2.

The application is disposed of.

CM(M) 579/2017 1.

The petitioner has filed this petition under Article 227 of the Constitution of India seeking issuance of directions to the Ld. Trial Court for concluding the proceedings in the Suit no. 58955 of 2016 within a time bound manner, without granting unnecessary and unwarranted adjournments.

2.

The grounds on which mainly the petitioner is seeking the direction is that the petitioner is 67 years old man suffering from old age ailments and residing in USA and is highly dependent on judicial system of India for effective adjudication of his grievance.

CM(M) 579/2017

3.

The above is not a ground to issue direction in a time bound manner as the learned Trial Court has to give priority to all the cases of senior citizens as well old cases.

4.

The petitioner has failed to point out from the proceedings of the learned Trial Court that he made any such request before the learned Trial Court which has not been acceded to or that long adjournments have been given.

5.

The petition is dismissed.
