W.P.(CRL) 1566/2017 & Crl.M.A.8735/2017 (directions) The petitioners, claiming to be majors, married each other on 19.05.2017. A specific statement has been made in the FIR that petitioner No.1 turned major on 30.04.2017 whereas the marriage took place on 19.05.2017. Since the marriage is not acceptable to respondent No.2, who is the father of petitioner No.1 (girl), he, even though, knew the fact that his daughter has married petitioner No.2, lodged a report leading to the registration of DD No.16A dated 08.05.2017, P.S. Alipur. Even respondent No.2 has stated the age of his daughter to be 18 years. The petitioners are present in court.

In this view of the matter, it is expected that the SHO of the concerned police station will get the statement of petitioner No.1 recorded under Section 164 Cr.P.C. so as to ensure that she has voluntarily married petitioner No.2 and would bring the investigation to a logical conclusion. Till such time that the investigation pursuant to DD No.16A dated 08.05.2017 is closed, all protection shall be afforded to the petitioners who come from poor strata of society. The petitioners will furnish their present residential address to the SHO of the concerned police station through Ms. Richa Kapoor, learned Additional Standing Counsel. The writ petition is disposed of.
