O R D E R
% 18.05.2018 Learned counsel for the petitioner submits that complainant has alleged in the FIR that petitioner took his brother-Imran with him on his motorcycle and thereafter Imran did not return home. However, Imran came back to his home on his own. His statement under Section 164 Cr.P.C. was recorded wherein Imran has not levelled any allegation that petitioner had taken him forcibly.
I have perused the statement of Imran under Section 164 Cr.P.C. wherein he has categorically stated that no one had kidnapped him. Keeping in mind the totality of the facts and circumstances, it is ordered that in case of arrest petitioner be released on bail, subject to his furnishing a personal bond in the sum of `10,000/- with one surety in the like amount to the
satisfaction of Arresting Officer/Investigating Officer/SHO of the concerned police station.
Bail application is disposed of in the above terms. Dasti.
