O R D E R

% 01.03.2017 The learned counsel appearing for the petitioner states that Mr K.K. Nangia has already been appointed as an arbitrator to adjudicate the disputes between the parties.

In the circumstances, it is directed that the present petition be considered as an application under Section 17 of the Arbitration and Conciliation Act, 1996 and the order passed on 27.09.2016 shall continue till till further orders are passed by the arbitral tribunal. The respondent is also at liberty to approach the arbitrator for vacation/modification of the order passed on 27.09.2016.

It is clarified that nothing stated in these proceedings may be construed as an expression of opinion on merits of the disputes between the parties and the arbitrator shall consider the present petition (as an application OMP (I) (COMM) 381/2016

under section 17 of the Act) uninfluenced by any observations made herein. The petition is disposed of.
