O R D E R

% 19.12.2016 This is an application filed under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.306/2016, under Sections 308/34 IPC, registered at Police Station-Fatehpur Beri.

Counsel for the petitioner has submitted that the petitioner is apprehending his arrest from Police Station- Fatehpur Beri in case FIR No.306/2016, under Sections 308/34 IPC. Learned counsel for the petitioner submits that the petitioner is an innocent person and is a law abiding citizen and the allegations made in the FIR No.306/2016, under Sections 308/34 IPC, registered at Police Station-Fatehpur Beri are false. He has further submitted that the petitioner is not named in the FIR. Learned counsel for the petitioner further submitted that the petitioner has already joined investigation and nothing is to be recovered further. He has submitted that the petitioner is further ready to join the investigation as and when required.

Learned APP for the State opposes the grant of anticipatory bail to the petitioner and has submitted that the petitioner refused to join TIP proceedings.

Learned counsel for the petitioner has submitted that the younger brother of the petitioner is working with the complainant in tollbooth and they knew the petitioner and because of this reason the petitioner refused to join TIP proceedings.

Keeping in view the facts and circumstances, the petitioner is directed to join the investigation and in the event of his arrest he be released on anticipatory bail in the sum of Rs.10,000/- with one surety of the like amount to the satisfaction of IO/SHO concerned. The present petition is disposed of accordingly. All pending application(s) (if any) also stand disposed of. Copy of the order be given dasti as prayed.
