% 22.01.2018 CO.A(SB) 2/2015 & CO.APPL. 32/2015 1) The learned counsel for the appellants says that the instant application had been filed against order dated 10 October 2014 passed by Company Law Board on an application moved by respondent no. 3 to 7. 1.1) I am also informed by counsel for the appellants that the appellants have entered into the settlement with respondents no. 3 to 7. 2) I am further informed by learned counsel for the appellants that an application for modification of order dated 10 October 2014 is pending with the NCLT. It appears that the application for modification has been filed for having the settlement recognised, and thus, obtain consequent permission for transfer of shares by respondent no. 4 to 7 in favour of appellant no. 2. 3) Having regard to the aforesaid submissions, according to me, nothing survives in the appeal.

4) The appeal is , accordingly, disposed of.

5) The appellants, however, will be at liberty to pursue their application pending before the NCLT.
