CRL.M.C. 2204/2017 This is a petition under Section 482 Cr.P.C. for quashing of FIR No.190/2015, under Sections 354-A/506/509 IPC, registered at Police Station Badarpur, New Delhi and all the proceedings emanating therefrom. Learned counsel for the petitioner has submitted that the petitioner and the respondent No.2 are neighbours and living in the same premises. Counsel for the petitioner further submits that due to a misunderstanding

arisen between the parties, the respondent No.2 got registered the aforesaid FIR against the petitioner. Counsel further submits that after the registration of the FIR, the near friends and the colleagues intervened in the matter and the dispute has been amicably settled between the parties and the same has been reduced into writing before the Mediation Centre, Saket Courts, New Delhi vide settlement agreement dated 15.02.2017 and nothing further remains to be adjudicated between the parties. Counsel further submits that though the matter has been amicably settled between the parties, however, the aforesaid FIR is coming as a hurdle in the peaceful life of the parties and prays that the aforesaid FIR may be quashed.

The respondent No.2, Smt.Jagdeshwari Devi is present in person and has been identified by the Investigating Officer ASI Tulli Ram, P.,S Badarpur, New Delhi and is also represented by her counsel Mr.Yogendra Singh, Advocate. The respondent No.2 present in person admit that she has amicably settled the dispute with the petitioner voluntarily and without any force, pressure or coercion and the same has been reduced into writing before the Mediation Centre, Saket Courts, New Delhi vide settlement agreement dated 15.02.2017 and nothing remains to be adjudicated further between the parties. She further submits that she has no objection if the aforesaid FIR is quashed.

Looking into the aforesaid facts and circumstances, since the matter has been amicably settled between the parties, who are stated to be neighbours and residing in the same premises, and the same has been reduced into writing before the Mediation Centre, Saket Courts, New Delhi vide settlement agreement dated 15.02.2017 and nothing further remains to be adjudicated between the parties, to have peace in the life of the parties

and better atmosphere in the neighbourhood, I deem it appropriate to quash the FIR and all subsequent proceedings arising therefrom. Consequently, the FIR No.190/2015, under Sections 354-A/506/509 IPC, registered at Police Station Badarpur, New Delhi and all the proceedings emanating therefrom are hereby quashed. The present petition is allowed and disposed of accordingly. Copy of this order be given dasti to the parties, as prayed. I.S.MEHTA, J MAY 26, 2017 'dc'
