The petitioners have filed the present petition inter alia praying that respondent nos. 1 and 2 (Government of NCT of Delhi and Directorate General of Health Services) be directed to ensure that relevant guidelines for providing free treatment to patients from EWS category are complied with by respondent no.3 (Jaipur Golden Hospital).

The petitioners claim to be persons from EWS category and in terms of the relevant guidelines they would be entitled to free treatment. 3.
The learned counsel appearing for respondent no.3 states that respondent no.3 is committed to provide free treatment to EWS category patients including the petitioners; and, in fact, medical treatment has been provided to the petitioners free of charge.
He, however, states that petitioners would be required to produce the EWS card for availing free treatment/medicines. On some occasions the petitioners have been charged for medicines on account of them not producing the EWS card at the relevant time.

He, further, states that respondent no.3 has also reimbursed the amount charged for medicines from the petitioners. In case of Smt Shanti Devi, the petitioner in W.P.(C)8837/2016, a sum of ?13,419/- was charged, which has, admittedly, been reimbursed to her. In case of Smt Geeta Devi, the petitioner in W.P. (C) 2995/2017, respondent no.3 had charged a sum of ?20,393/- out of which a sum of ? 16,428/- has already been reimbursed. He further states that balance amount will be reimbursed within a period of two weeks from today.

In view of the above, the prayer made by the petitioners for reimbursement of the amount paid to respondent no.3 for medicines stands addressed.

Insofar as implementation of the guidelines are concerned, this Court is informed that the Government of NCT of Delhi has placed a Nodal Officer and Liaison Officer at the Hospital (respondent no.3). In the event
the petitioners are denied treatment at any stage or any charges are demanded from them, they are free to approach the Nodal Officer and/or Liaison Officer who shall ensure that the guidelines are duly implemented by respondent no.3. The Nodal Officer/Liaison Officer shall also submit the report of all complaints received by it to the respondent nos. 1 and 2 in order for the said respondents to take appropriate steps for enforcement of the relevant guidelines. No further orders are required to be passed in these petitions.

The petitions are disposed of with the aforesaid observations. 8.
