At the outset, we have requested learned counsel for the petitioner to address us on the maintainability of the writ petition before the High Court when the petitioner has not approached the Tribunal under the Administrative Tribunal Act, 1985, for relief. 2.
On the first call, learned counsel for the petitioner had sought a passover to check up the legal position.

On the second call, learned counsel for the petitioner seeks leave to withdraw the present petition while reserving the right of his client to approach the Central Administrative Tribunal for relief, as prayed for in this petition.

Leave, as prayed for, is granted. The present petition is dismissed as withdrawn alongwith the pending application.
