This is an application under Section 11 of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as the 'Act') filed by the petitioner seeking appointment of a Sole Arbitrator. 2.
The disputes between the parties have arisen out of the Franchise Agreement dated 18th November, 2010. Clause 19.1 of the agreement provides for dispute resolution through arbitration of a Sole Arbitrator.

The learned counsel appearing for the respondent submits on instruction that the respondent has no objection if an arbitrator is appointed and the parties are referred to Delhi International Arbitration Centre.

With the consent of both the parties, I hereby direct that the
parties shall appear before the Delhi International Arbitration Centre (DIAC) on 1st December, 2017 at 2.00 p.m. who shall appoint a Sole Arbitrator to adjudicate the disputes between the parties. The arbitration and the fee shall be governed by the Rules of the DIAC. 5.
The petition is allowed in the above terms.
