In view of the facts and circumstances explained, the delay in filing the appeal is condoned and the application is disposed of. LPA No.567/ 2016 1.

C.M.No.5767/2016 filed by the appellant herein under Order I Rule 10 of CPC seeking its impleadment as party respondent to W.P.(C) No.11903/2015 was dismissed by the learned Single Judge by order dated 27.07.2016. Aggrieved by the same, the present appeal is filed. 2.

At the outset, it is brought to our notice that W.P.(C) No.11903/2015 has already been disposed of by the learned Single Judge by order dated 19.10.2016.

In the circumstances, if aggrieved it is for the appellant to

challenge the final order in the writ petition dated 19.10.2016. The learned Senior Counsel appearing for the appellant states that appropriate steps would be taken accordingly.

The appeal is accordingly disposed of granting leave and liberty to the appellant to file a fresh appeal assailing the order dated 27.07.2016, i.e., the order impugned in the present appeal as well as the final order in the writ petition dated 19.10.2016.
