% 18.07.2017 This is an application under Section 439 Cr.P.C. filed on behalf of the petitioner seeking grant of bail in case FIR No.315/2016, under Sections 307/506/34 IPC, read with Sections 25 & 27 Arms Act, registered at Police Station- Karawal Nagar.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and is in J.C. since 17.09.2016. He further submits that nothing has been recovered at the instance of the present petitioner as the petitioner was not assailant to which the injury on the person was caused. He also submits that the co-accused Rupak Sharma has already been released on anticipatory bail and the role of the present petitioner is quite similar to that of co-accused and prays that the petitioner be released on bail.
On the other hand, learned APP for the State vehemently opposes the bail application. He further submits that the present bail application is devoid of any merit and prays that the same be rejected. Heard.

The fact emerging on the record is the order passed by this Court in Bail Application No.136/2017 and Crl. M.A. No.1284/2017, wherein the coaccused Rupak Sharma was granted bail on his furnishing bail bond in the sum of Rs.20,000/- with one surety of the like amount to the satisfaction of the Investigating Officer/SHO concerned and also the role of the present petitioner is similar to that of the co-accused Rupak Sharma. Therefore, on the question of parity, I admit the petitioner on bail on his furnishing bail bond in the sum of Rs.20,000/- with one surety of the like amount to the satisfaction of concerned Court with the condition that he shall not influence the prosecution witnesses; he shall not tamper the prosecution evidence; he shall not contact, threaten or coerce the complainant or any of his/her family members; he shall not indulge in any illegal activities; he shall not leave India without prior permission of the concerned Court. The present bail application is allowed and disposed of accordingly. Copy of this order be given dasti.
