% 04.02.2016 The present petition has been filed by the petitioner under Section 482 of Code of Criminal Procedure, for setting aside the order dated 23rd September, 2014 passed by the learned Metropolitan Magistrate and the order dated 1st May, 2015 passed by the learned Additional Sessions Judge, rejecting the petition of the petitioners under Section 156 (3) of Code of Criminal Procedure (Cr.P.C.) for issuing direction qua the registration of the FIR. During the course of argument, the complaint filed under Section 156(3) of Cr.P.C. before the Court does not find mention about approaching the S.H.O. for the registration of the case on the basis of the allegations made by the counsel for the petitioners.
Learned counsel for the petitioner wishes to withdraw the present petition with liberty to approach the SHO concerned qua the registration of the FIR on the basis of the allegations levelled. The present petition is dismissed as withdrawn with liberty as prayed for.
