CORAM:

HON'BLE THE CHIEF JUSTICE HON'BLE MR. JUSTICE TUSHAR RAO GEDELA

O R D E R

% 27.03.2025 CM APPL. 34717/2024 1.

Mr. Sameer Vashisht, learned Standing Counsel representing the GNCTD, on instructions, has submitted that the State Government is committed to make an appropriate statutory mechanism to regulate the Pathological Labs/Clinical Establishments in the State of Delhi. He has stated that the order passed by this Court on 06.02.2025 has been communicated to the appropriate authority of the Government, which is conscious of the same and he has been instructed to assure the Court that all possible steps shall be taken to bring the appropriate legislative regime for the said purpose at the earliest.

On such assurance being given by the State Government, we hope and The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 01/07/2025 at 22:58:11

trust that the Government shall act in appropriate direction at the earliest. The urgency in the matter is apparent for the simple reason, that the present day statutory mechanism available in the 1954 State enactment appears to be inadequate and obsolete and therefore having regard to 2010 Central enactment and considering the present day problems being posed in regulating such clinical establishments, it is most expedient for the Government to act at the earliest.

3.

On the prayer made by Mr. Vashisht, list the matter on 09.07.2025. 4.

The status report giving all the action taken for ensuring the compliance of this order and all earlier orders shall be filed by way of an affidavit, which shall be sworn in by the Secretary Incharge, Department of Health of the State Government.
