% 19.12.2016 Petitioners and respondent no. 2 in both the above writ petitions have prayed for quashing of the following cross FIRs:- By:AMULYA

(a) FIR No. 122/2014 under Sections 420/467/468/471/506 IPG registered at P.S. Anand Vihar on the complaint of Mr. Rakesh Sharma, petitioner no. 2 in W.P.(Crl.) No. 2967/2016 and respondent no. 2 in W.P.(Crl.) No. 2957/2016.

(b) FIR No. 625/2014 under Sections 420/465/466/467/468/120-B IPG registered at P.S. Anand Vihar on the complaint of Mr. Rajinder Pal Singh, petitioner no. 1 in W.P.(Grl.) No. 2957/2016 and respondent no. 2 in W.P.(Grl.) No. 2967/2016.

Property disputes among Vaibhav Sharma, Rakesh Sharma and Dushant Sharma on the one hand and Rajinder Pal Singh and Simrdeep Singh on the other had led to registration of the aforesaid two FIRs. It is submitted that there were seven other civil litigations between the parties. All the civil disputes as well as criminal disputes involved in the FIRs have been settled before the Mediation Gentre followed by the Memorandum of Undertakings/Agreements, both dated 27^*^ July, 2016. It is submitted that Rakesh Sharma has paid Rs.60 lacs to Rajinder Pal Singh, in terms of the settlement.

Rajinder Pal Singh admits having received this amount. Gomplainants, Rakesh Sharma and Rajinder Pal Singh in the above noted FIRs, submit that they have settled their disputes of their own free will and

without any undue force, coercion and pressure. They further submit that they are not willing to pursue the aforesaid FIRs any further. Keeping in mind the above facts, in my view, no fmitflil purpose would be served to keep the criminal proceedings pending, in view of the settlement arrived at between the parties. Accordingly, in the interest of justice both the FIRs, that is, FIR No. 122/2014 under Sections 420/467/468/471/506 and FIR No. 625/2014 under Sections 420/465/466/467/468/120-B IPC, both registered at P.S.
