O R D E R

% 28.02.2017 This is an application under Section 438 Cr.P.C. moved on behalf of the petitioner Nitin Chaudhary @ Nitin Kumar for grant of anticipatory bail in case FIR No.608/2016, under Sections 308/452/323/427/34 IPC, registered at Police Station K.N.Katju Marg, Delhi. Counsel for the petitioner submits that the petitioner is a law-abiding citizen and the petitioner has already joined the investigation and the petitioner is not required for further custodial investigation and there is no evidence to connect the present petitioner with the alleged offence in the aforesaid FIR and prays that the petitioner may be released on anticipatory bail.

Status report has been filed by the State. Learned APP for the State, on the other hand, vehemently opposes the grant of anticipatory bail to the

petitioner and submitted that the present bail application is devoid of merit and the same is liable to be dismissed. However, the present petitioner has joined the investigation.

Keeping in view the facts and circumstances, the petitioner is directed to join further investigation as and when required to do so and in the event of his arrest, the petitioner be released on bail, on his furnishing bail bond in the sum of Rs.20,000/- with one surety of the like amount to the satisfaction of the Investigating Officer/SHO concerned with the condition that he shall not leave the country without prior permission of the Court below and shall not tamper with the prosecution evidence.
