BAIL APPLN. 2040/2016 The petitioner has preferred the present petition to seek regular bail in case FIR No.279/2012 under Section 363/ 366/ 376 IPC and Section 4 of the POCSO Act.

The regular bail application of the petitioner has already been dismissed by the Trial Court on 21.09.2016. The Trial Court has observed

that the trial is likely to be completed in the near future. The Trial Court has also concluded that there is likelihood of the petitioner fleeing from justice. The petitioner, admittedly, is a married man having a child. He developed a relationship with the prosecutrix. The allegation against him is that he did not disclose his correct identity to the prosecutrix, or the fact that he is married and has a child. The prosecutrix has been examined before the Court and she has supported the allegations against the petitioner. I am, therefore, not inclined to release the petitioner on bail at this stage. However, it is directed that trial should be completed as early as possible, and preferably within the next four weeks. Neither the petitioner nor the prosecution shall seek undue adjournments before the Trial Court. The petition stands disposed of in the aforesaid terms. VIPIN SANGHI, J OCTOBER 03, 2016 B.S. Rohella
