% 30.07.2018 This petition seeking quashing of the proceedings arising out of case FIR No.10/2016, under Sections 323/354/354B/394/452/34 IPC registered at Police Station New Delhi Railway Station was filed on the basis of submission that the matter had been amicably settled with the complainant, i.e. private party respondent.

The petition, however, is resisted by the complainants/victims. It is nonetheless pressed to question the merits of the case against the petitioners.

The learned counsel for the private party respondent, however, points out that cognizance was taken by the competent court on which process was issued under Section 204 Cr.P.C. and later even charge has been framed, the case being presently at the stage of prosecution evidence, which order has not been challenged.

CRL.M.C. 3667/2016

If that be so, this petition cannot survive. The petitioners may avail of remedy vis-a-vis the subsequent orders, particularly the order framing charge, in accordance with law.
