% 05.10.2016 The nominal roll has been received.

By this petition, the petitioner seeks parole to re-establish social ties. The nominal roll shows that the petitioner stands convicted in case FIR No.207/2000 under Section 307/ 186/ 353/ 332/ 397/ 34 IPC at Police Station - Tilak Nagar. The maximum sentence awarded to the petitioner under Section 307 IPC was five years Rigorous Imprisonment with fine of Rs.5,000/-. In default of payment of fine, he was required to undergo 6 months of Simple Imprisonment. This Court, in appeal, has reduced the said sentence to two years for the offence under Section 307 IPC as well as under

307/ 37 IPC and 392/ 34 IPC, while the other sentences have been retained. The other sentences were 1 year Rigorous Imprisonment apart from fine. Learned counsel for the petitioner states that the fine imposed upon the petitioner have already been paid.

In any event, the petitioner has undergone 1 year and 6 months of incarceration as on 03.10.2016 and the remaining sentence is only 2 months after accounting for remission. The jail conduct of the petitioner has been found to be satisfactory.

Keeping in view the aforesaid, the petitioner is entitled to parole. He is directed to be released on parole for a period of one month on furnishing personal bond with one surety in the sum of Rs.10,000/- to the satisfaction of the Jail Superintendent. At the time of his release, he shall provide his mobile phone number, which shall be kept in working condition at all times and shall not be changed without prior intimation to the Court. He shall report at the local police station on every Monday at 11:00 a.m. to mark his attendance during the parole period. He shall duly surrender at the end of the parole period.
