% 24.05.2017 Crl.M.A.8899/2017 Exemption allowed, subject to all just exceptions. The application stands disposed of.

W.P.(CRL) 1599/2017 The petitioner seeks extension of the parole which was granted to him by the competent authority by order dated 22.03.2017. The petitioner was granted parole for a period of three weeks by the aforesaid order for him to be present with his wife around the period of her expected delivery. The aforesaid period of parole expires on 26.05.2017. Learned counsel for the petitioner has submitted that his wife has delivered on 15.05.2017. The petitioner had applied before the competent authority for extension of the period of parole on 22.05.2017. Taking into account the fact that the period of parole granted by the

competent authority is expiring on 26.05.2017, this Court is inclined to entertain the present petition.

The status report which has been filed by Mr.Kundu, Additional Standing Counsel today in Court and which has been taken on record certifies that the wife of the petitioner has delivered on 15.05.2017. Taking into account the aforesaid fact namely the delivery of the child only recently i.e. on 15.05.2017, this Court has been persuaded to extend the period of parole for a further period of two weeks, to be counted from 26.05.2017. The conditions which were imposed on the petitioner by order dated 22.03.2017 shall remain in force. The petitioner shall positively surrender on or before the expiry of the two weeks. The petition is disposed of.

The order be communicated to the Superintendent of the concerned jail for compliance and record.
