O R D E R
% 07.12.2015 Learned counsel for the petitioner while pressing the bail application of the petitioner submits that some dispute with respect to return of gold ornaments had remained unresolved. For the purposes of setting at rest the aforesaid controversy between the husband and the wife, monetary value of such gold ornaments were quantified and an amount of Rs.80,000/- was agreed upon between the parties for being paid by the petitioner to the complainant.
Rs.45,000/- out of such agreed amount was paid on earlier occasion, which fact stands admitted by the complainant who is present in Court. Today, as part of the agreement between the petitioner and the complainant, the balance amount of Rs.35,000/- has been paid to the complainant in Court which has been accepted by her. Let it be made clear that the aforesaid payment is only with respect to
the money which has been quantified in lieu of the gold ornaments. It may not be taken as an amount for finally settling the dispute between the parties. Considering the aforesaid facts, the petitioner is directed to be released on bail, in the event of his arrest, on his furnishing a bond in the sum of Rs.10,000/- with one surety of the like amount to the satisfaction of the Arresting Officer of the case.
