% 27.11.2017 The petitioner was granted interim protection on 25.05.2017. She is stated to have joined the investigation. The petitioner and two other persons i.e. Mr. Surinder Kumar Garg and Mr. Anil Kumar Jindal were Directors in M/s Shiva Trading Company.
The proceedings were initiated against all three on a complaint of one Mr. Kailash Jain. The petitioner's husband Mr Surinder Kumar Garg and the other Director Mr. Anil Kumar Jindal have since been granted regular bail.
The respondent opposes the interim protection on the ground that petitioner's custodial interrogation is necessary. However, the Court finds that only the documents are required to be obtained from the petitioner. These are the same documents which were sought from the other two persons who have been granted regular bail and
their role is stated to be almost identical with the petitioner. Therefore, no special case is made out for her custodial interrogation in a case pertaining to alleged financial fraud pertaining to the year 2005-2006. Since the petitioner has joined the investigation and is participating in the same, the interim order dated 25.05.2017 is confirmed. The bail application stands disposed off.
