The petitioner has filed the present petition seeking a direction to respondent no.2 to expeditiously dispose of the complaint filed by the petitioner under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 (being petition no. 09 (1435) of 2015). There is a serious issue as to the maintainability of the aforesaid petition as it is claimed by respondent that the gift deed sought to be challenged by the petitioner was executed pursuant to mediation before the Mediation Centre and in terms of the settlement which resulted in disposal of the litigation between the parties (including the suit pending before this Court). 2.

In view of the aforesaid circumstances, this Court by an order dated 11.07.2017 (in W.P.(C) 5697/2017) has directed the Maintenance Tribunal to consider respondent no.2's contention regarding maintainability of the

petition before proceeding further.

It is expected that the Tribunal shall dispose of the complaint (petition) as expeditiously as possible. 3.

No further orders are required to be passed in this petition and the same is disposed of.
